You must not copy or republish material from ModusStack; sell, rent, or sub-license material from ModusStack; reproduce, duplicate or copy material from ModusStack; or redistribute content from ModusStack.

For custom deliverables produced under the AI Stack, Dev Stack, and Growth Stack, absolute ownership of the final specific source code and operational assets will be formally transferred to the Client only upon full settlement of all milestone invoices and outstanding fees. ModusStack retains the right to utilize foundational, non-proprietary code snippets and architectural methodologies developed during production for internal and external enterprise applications.

Fees, Payments, and Refund Policy:

  • General Non-Refundability: Due to the digital, strategic, and highly custom nature of our services, all payments made to ModusStack are non-refundable. Once technical resources are allocated and strategic production begins, no refunds or pro-rata balances will be issued under any circumstances.

  • Creative Stack (Fixed-Price Packages Satisfaction Guarantee): At ModusStack, we are fully committed to delivering visual assets that align perfectly with your brand strategy. Because our services involve immediate resource allocation and dedicated digital production, we do not operate a traditional cash-refund policy once a project is initiated. Instead, to ensure absolute peace of mind and guarantee your satisfaction, every fixed-price package includes two (2) comprehensive rounds of revisions completely free of charge. We work closely with you during these iteration phases to refine, adjust, and perfect the deliverables to match your exact standards.

  • AI, Dev, and Growth Stack (Bespoke/Milestone Services): For all custom development, AI integration, and growth acceleration infrastructure, payments are structured strictly based on an upfront deposit or formal project milestones. Upon the completion and handover of each designated milestone, the corresponding payment is considered fully earned by ModusStack and is entirely non-refundable. If a project is terminated prematurely by the Client, any completed work and allocated retainers remain the property of ModusStack.

Termination:

We reserve the right to terminate or suspend access to our services and website immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever, including but not limited to a breach of these Terms and Conditions. Upon termination, your right to use our proprietary systems, unpaid deliverables, and ongoing infrastructure optimization will cease immediately. All provisions of the Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

Hyperlinking to our Content:

The following organizations may link to our Website without prior written approval: Government agencies; Search engines; News organizations; Online directory distributors may link to our Website in the same manner as they hyperlink to the Websites of other listed businesses; and System-wide Accredited Businesses.

These organizations may link to our home page, to publications, or to other Website information so long as the link: (a) is not in any way deceptive; (b) does not falsely imply sponsorship, endorsement, or approval of the linking party and its products and/or services; and (c) fits within the context of the linking party's site.
